Divorce Procedure

The process of obtaining a divorce is usually quite straight forward in particular if the couple agree that their marriage is over.

Who can start divorce proceedings?
Anyone who has been married for over a year provided one or other of the couple is either domiciled here or has been resident in England or Wales during the preceding year.

Grounds for divorce?
The only ground for divorce is that the marriage has irretrievably broken down and if one of the five facts laid down by law, proving irretrievable breakdown is established.

What are the “facts”?

Adultery

Unreasonable behaviour

Desertion for a continuous period of 2 years or more

Separation for 2 years or more with consent

Separation for 5 years or more without consent

How much does the divorce cost?
This depends on the finances of each party to the divorce. We also offer fixed fee arrangements.

Are financial issues dealt with before the divorce is finalised?It is not essential for financial matters to be concluded before the divorce is final.
