No fault divorce
In April 2022, a new ‘no-fault’ divorce law was introduced. This allows couples to seek a divorce without the need for either of them to allege issues such as adultery, unreasonable behavior, or desertion. The law is intended to make the process of divorce easier and less acrimonious.
Now, one or both parties can simply state to the court that their relationship has irretrievably broken down. There is no scope to contest a divorce anymore, meaning that the process should run smoothly.
If you are seeking a divorce, our family law solicitors can make the application on your behalf. Once the initial paperwork has been received by the court, there must be a period of twenty weeks before the court will grant a conditional order. This is intended to give those involved time to reflect on the decision that has been made.
Once a conditional order has been granted, a period of six weeks must elapse before the final order is made.
Fixed Fees for divorce
We offer fixed fees for the process of obtaining a divorce, so that you will know from the start how much it will cost.
Where you are seeking a no-fault divorce, our fees are £750 + VAT.
Financial agreements in divorce
It is essential to deal with financial matters during a divorce. Without a binding financial order, it could be open to your former spouse to make a claim against you long into the future.
We can work on your behalf to negotiate a financial settlement without the need for court. This is quicker than going to court and generally more cost-effective. It will include issues such as division of your shared home, pension splitting, sharing savings and investments and dealing with business holdings.
If we are able to reach an agreement with your spouse and their solicitor, we will arrange for this to be put into writing and sealed by the court, making it legally binding. If an agreement cannot be reached, we will prepare a strong case for court on your behalf and ensure that you are represented by a family law expert.
Arrangements for children in divorce
If you have children, then you are advised to put legally binding arrangements for them in place. This will include details of where they will live, what time they will spend with each parent, how they will stay in touch with each parent while they are not together and other issues such as holidays, education and the other people they will see.
Our family law solicitors will work with you to try and reach an agreement over these issues without the need for a court hearing wherever possible. Resolving matters without litigation can help parents to work together to put arrangements in place that are in the best interests of the children and can avoid a relationship deteriorating further.
Where it is not possible to agree on matters, we can guide you through the mediation process. It is usually a legal requirement that mediation is attempted before you can ask the court to intervene. Mediation with a trained and neutral mediator can help couples work together to put arrangements in place that are tailored to be right both for you and your children.
